Jennifer Ioli Connelly, a partner in Sherin and Lodgen’s Renewable Energy Group, will present on how to integrate renewable energy – specifically solar + battery storage – into a commercial real estate portfolio, and the legal implications that come up in negotiating leases and power purchase agreements.

This session will address today’s challenges and legal implications when integrating renewable energy into commercial real estate projects, and will relate to the conference theme in echoing the importance of climate resilience through these implementations that help drive more sustainable real estate.
To address these issues, the session will cover the following:
-How to determine if the portfolio or property is right for solar, and the benefits of engaging qualified solar consultants to explore options from industry leaders like Black Bear Energy.
-Analysis of operational concerns including building occupants. For example, if you own an industrial warehouse and would like to put solar on the roof, how do your leases with your building tenants interplay with this?
-Third-party stakeholders that may need to approve the initiative including lenders, joint venture partners, tenants, associations, CCRs, etc.
-Negotiation of lease and power purchase agreement forms and understanding the industry standards unique to renewable energy –including financeability of solar leases, which can be unlike “regular” commercial real estate deals.
-The importance of having legal counsel who understands industry nuances and a team of people who are committed to the goal internally.
